Mentally Disabled May be Soon Able to Divorce in Illinois

The Illinois Supreme Court has ruled that the state ban on people with mental disabilities or their guardians getting a divorce is “no longer appropriate.” The law applied to individuals with severe brain damage, as well was adults with Alzheimer’s disease or mental illness. The court found a blanket ban on all divorce actions was not appropriate, but that case-by-case hearings should be conducted to determine whether the divorce was in the disabled person’s best interests.
